Indiana provides two ways to address this problem. First, you may qualify to apply for Specialized Driving Privileges (formerly called a Hardship License) which may allow you to drive with certain rules set by the court. This usually includes work, school, medical, and other basic needs. Second, you may apply for an Ignition Interlock which may allow you to drive when your car is equipped with a breath test device. Although the decision is up to the judge, Specialized Driving Privileges or an Ignition Interlock may help you carry on with your life until your case is resolved.

REPEAT OFFENDERS

Indiana has enacted repeat offender Drunk Driving laws to keep unsafe motorists off the roads. If you have a previous OWI offense, you may face additional penalties such as:

  • Being charged with a higher level of crime with harsher penalties.

  • Mandatory minimum jail sentences or community service obligations.

  • Mandatory minimum driver’s license suspension.

  • Habitual Vehicular Substance Offender enhancements which can add up to eight extra years in prison.

  • Habitual Traffic Offender status which can result in up to a lifetime license revocation.
